Local media reported the THB3 billion Aetas Bangkok and neighboring Aetas Residence on Soi Ruamrudee must be partial demotion for breaching height limits set for the street. Courts ruled the two buildings in central Bangkok must be reduced to eight floors to comply with the 23-meter building height limit set for Ruamrudee.
The court told Bangkok Metropolitan Administration and the Pathumwan district office that the 24-story Aetas Bangkok and 18-story Aetas Residence surpass the height limit for a road that is less than 10 meters wide. This height is set by the building control law.
The ongoing legal saga between residents of the street and building owners have been ongoing for years. Local media noted that the Supreme Administrative Court ruled the buildings to be partial demolition nearly two years ago. The owners of the properties, Lappratan owns Aetas Residence and Taptimthorn Co, is the owner of Aetas Bangkok, petitioned against the ruling and also filed a complaint of their own against the street width.
The two hotels, which opened in 2010, had continued to operate while their petition was working its way through the court system. The Pathumwan district office had also ordered an end to the use of the buildings but no action has been taken as of yet while all sides waited for the Central Administrative Court decision.
With Aetas Bangkok and Aetas Residence having its petition rejected and their complaint dismissed, it appears as if the owners are running out of options. The two luxury properties boast a combined total of 423 rooms as well as a number of serviced residences. Construction on the project began in 2005.
While there are a number of tall buildings near Soi Ruamrudee such as the Novotel Ploenchit and Conrad Hotel, these are situated on other streets allowing the owners of these to avoid the building height laws.
