Homebuyer Complaints Against Developers On The Rise

The Consumer Protection Board (CPB) is currently dealing with more than 3,000 cases that involve disputes between homebuyers and real estate developers, reports local media. In order to combat this, the CPB has tentatively agreed to several measures that are designed to address these issues.

Property-related issues are now top on the list of complaints sent to the office, says a CPB spokesman to the Bangkok Post. It was decided to create new measures that are more integrated and able to better solve real estate-related consumer issues. Some of these measures will amend existing laws while others will certify and reward developers with good records concerning homebuyers’ rights protection.

The Council of Engineers, Engineering Institute of Thailand, Office of Natural Resources and Environmental Policy and Planning, Department of Lands, Department of Public Works and Town and Country Planning, and local administration organisations will work with the CPB to combat the rising complaints.

Post-construction damage, a lack of essential public utility services provided as advertised, unfinished construction, construction cancellation, delays in transferring the proprietary right from the developer to homebuyers, and disputes over project management are the issues most reported to the CPB, according to the Bangkok Post

Most of these problems come from buyers who fail to pay attention to details in the sales contracts before they sign them. The CPB urges all homebuyers to thoroughly examine the entire contract before signing and compare the details to claims that have been made by the developer. This will ensure buyers are able to receive everything that has been promised to them.

Should a developer not provide all claims that have been made in a contract and any marketing materials, homebuyers will be able to use these documents as evidence. This will allow them to show if a developer has failed to fulfil their obligations.
