Named the Thai Rental Law, it affects rental properties that form part of a business. Any person who owns in excess of five rental properties is now classed as a business operator who has a contract controlled business. <a href="https://www.ddproperty.com/en/property-resources/for-rent-guide/how-to-be-a-good-landlord-for-a-successful-investment-9250" target="_blank" rel="noopener noreferrer">Landlords</a> who have less than this magic number are not bound by these new regulations, so the following does not apply.</p>
<p>For those who do, there is a change in how utilities are charged, the deposit and the termination of the tenancy. Starting with the utilities, business operators are not allowed to charge to their tenants an inflated price for the utilities. A practice that is commonly used as a way for the business operator to generate an additional income.</p>

To protect the tenant’s deposit, an inventory check in that details the condition of the property and its content, must be attached to the tenancy agreement too.</p>
<p>This document will be used to check the condition at the end of the tenancy to determine the deductions, if any, from the deposit. The business operator also must return the deposit within seven days of the tenancy termination.</p>

<p>These new regulations became effective on 1 May 2018, but remember, they do not apply to everyone so check how many properties your landlord owns to see how your tenancy should be structured.</p>

These issues can easily be resolved and avoided if you know your legal rights.</p>
<p><span style="color: #ff0000;"><strong>1. How to deal with a tough and stingy landlord</strong></span><br />This is perhaps one of the most common issues that tenants may face. The landlord that refuses to make necessary repairs and maintenance to their rooms such as replacing worn out things, dealing with water leaks, fixing the AC that is not cool or even dealing with termites because they don’t want to pay! By law, it is the land lord’s sole responsibility to carrying out all necessary maintenance and repairs to their property where the damage and deterioration is not caused by the tenant doing throughout the contract’s duration. Therefore the land lord cannot refuse to make repairs nor push over the cost to you.</p>
<p><span style="color: #ff0000;"><strong>2. Accept the penalty fee</strong></span><br />It is normal for every tenant to accept the terms and conditions set forth in the rental contract including placing deposit money. Most tenants may find that they didn’t get their money back or may find that a large chunk have been deducted from the original sum. Tenants may be penalised for breaking or damaging things in the room such as torn mosquito nets, leaving deep scratches on the table or drilling holes in the walls. These conditions are clearly set forth in the rental contract in accordance to the Thai Civil and Commercial Code section 546-563, carefully read them. Once you have signed the contract then you are obligated to it. The only way out is to not damage or destroy anything.</p>
<p><span style="color: #ff0000;"><strong>3. Issues with the central management</strong></span><br />Problems with the building’s management not only causes headache to tenants but also to the room owners also. Owners pay an annual maintenance to fee to the central management to pay for the property’s upkeep and improvement. However, it is not uncommon to find that management has failed to provide adequate maintenance and repairs to the building. Leaking water pipes, broken light bulbs or even smelly drains are some issues resulting from poor maintenance. If this is the case, tenants and owners can refer to Section 48 Part 3 that states that “collecting annual maintenance fee from members for maintaining public utility, estate management have the duty to provide maintenance and repairs for members”. It is necessary for tenants to get the respective owners to lodge complaints with central management.</p>
<p><strong><span style="color: #ff0000;">4. Stealing parking space</span></strong><br />This is one of the most frequent problems that condominium tenants have to face and have caused a lot of aggravation to many people. This is because most condominium does not have enough parking spaces for everyone in the building. If you want to avoid this problem, you may have to start right at the beginning when you are considering a place to rent. The 7th Ministerial Regulation states that each condominium project must provide at least one parking space per family.</p>
<p><strong><span style="color: #ff0000;">5. Not enough lifts and they are so slow!</span></strong><br />This is another annoying issue for many condominium dwellers particularly during rush hour when everybody need to get moving. Thailand’s Building Control Act states that a building must provide one lift for every 100 units. However, this is relative lift speed. Buildings not exceeding 10 floors have a lift speed of 60 meters/ minute, buildings not exceeding 25 floors at 90-125 meters/ minute and buildings exceeding 25 floors at 120 meters/ minute. Each lift must have a load capacity of 630 kilograms minimum across the board. Each building must also have a fire lift.</p>
<p><span style="color: #ff0000;"><strong>6. The security guards</strong></span><br />Many people may have gripe with the building’s security guard, from negligence of their duty, allowing non- residents to enter the building, allowing people outside to occupy the scarce parking space or using communal facility. If you face these issues you can inform the central management and have them deal with it. This is because legally, the central management has the full authority in managing every aspect of security with the premise of the property.</p>
<p><span style="color: #ff0000;"><strong>7. Smell of tobacco and food odor</strong></span><br />Pungent food odors in the building usually originate from the kitchen as most condominiums have an open kitchen design, the smell of cooking can creep out of the room and bother other inhabitants, particularly when it’s Thai food. This is a bigger problem with older projects that lack proper ventilation system to deal with such odors. For the smell of tobacco, this may come from smokers smoking in prohibited areas as every building is required to have smoke detectors and are required to vent 140 cubic meters of air per hour out of the building. If you face the problem of tobacco smell from other rooms bothering you, you can inform central management to deal with them.</p>
<p><strong><span style="color: #ff0000;">8. The pain from pets</span></strong><br />This problem usually occurs in condominiums that prohibit keeping pets but the stubborn neighbor refuse to oblige and the noise, or even the odor, may bother other people. Central management has the authority and responsibility in deal this issue for you in accordance with the Public Health Act 1992 which states “any act that causes annoyance to other people living close by can be considered public disturbance according to section 25”.</p>
<p><span style="color: #ff0000;"><strong>9. Inadequate rubbish collection.</strong></span><br />According to the 50th Ministry Regulation 1997 require every condominium to have an area set aside for rubbish deposit with a minimum holding capacity of 2.40 liters on every floor of the building with adequate system to contain foul smell. If the building that you live in does not comply with this regulation, tenants can inform the owner to lodge a complaint with central management.</p>
<p>Knowing your rights that is set forth by law and knowing how to deal with the problems properly can help solve many annoying issues. But it is best to choose carefully when you are looking for a new place to stay. It is advised for you to take the time to look for newer projects that have modern security, good public utility, efficient and competent central management and also a friendly land lord.</p>

Besides a higher rent price, a furnished unit is normally more desirable than a bare room; most tenants want a room that is ready to live in. In the meantime, you need to make sure the rent price is not set too low, otherwise you would earn too little as you should. If you can’t come up with an exact number, then leave it to the juristic office who has a standard price and assist you in rent collection.</p>

<p>Besides paying a full amount at once, you could own a condominium unit while repaying a mortgage loan borrowed from bank. <p>Tenants who are students will most likely prefer locations which are near to their schools, while tenants who are families with young children will prefer a neighbourhood with playgrounds, parks and other amenities which would provide for a suitable environment for their children to grow up in.</p>
<p>There is also the issue of the term of lease. Some tenants may only be looking for a temporary place to stay as their own homes may be undergoing renovation works, or they might be in the process of moving to a new home that isn't ready.</p>
<p>Others may be looking for a property to reside in indefinitely. Therefore, since there is such a wide range of tenants to choose from, it is up to you as the landlord to decide what type of tenant you want.</p>
<p>There are four basic guidelines that landlords should keep in mind when furnishing a rental property for prospective tenants.</p>

<h3>Consider what your tenant will most likely need.</h3>
<p>When you begin preparing an apartment or a house for leasing, you have to consider what your tenant will most likely need. Be prepared to fill it with basic furnishings and fittings such as kitchen cabinets, a washing machine and a gas stove.</p>
<p>You should also be prepared to replace things which are no longer in a suitable working condition, such as light bulbs, showerheads and doorknobs, or to install additional fittings - for example, if you think a room is too dimly lit, you should install additional light fixtures. At the very least, tenants will look for an apartment that is clean and where everything is in a satisfactory working condition.</p>
<p>It is important that your prospective tenants are able to imagine themselves living there. Remove any personal items from the rental property and be prepared to invest in a paint job. It is advisable to paint the apartment or house in neutral colours, as you never know what your prospective tenant's colour preferences are like.</p>
<p>Also, in the event that your tenant does not renew his or her term of lease, it saves you the trouble of re-painting the property for the next prospective tenant.</p>
<h3>Be prepared to answer lots of questions.</h3>
<p>Tenants may ask questions regarding anything from bus services in the area and neighbourhood schools to how the kitchen appliances work.</p>
<p>While it is not recommended that you hover in the background as prospective tenants view your property, you should make sure that you are readily available to answer their questions.</p>
<h3>Be flexible with rental home viewings.</h3>
<p>Interested tenants may visit at all times of the day, so try to be as accommodating as possible, especially if a prospective tenant visits more than once. This could be because the tenant is trying to gain a feel of the neighbourhood at different times of the day, or that the tenant has become confused after viewing several rental home options in a short period of time.</p>
<h3>Do not object if prospective tenants take pictures of your rental property.</h3>
<p>This is to help them remember how your property looks like, more than anything else. Most tenants and buyers view plenty of homes before choosing one and it may get difficult for them to remember how a property looks like after viewing several options in one day.</p>

If you do not want to do the cleaning yourself, hire a house-cleaning service to take care of it.</div>

In some cases, you may need to paint the flat or house over in neutral colours so that there's a better chance of your home appealing to the masses.</div>

<div>Check that there is no odour or foul smell in the air. If you have a pet, it is likely that there is an odour and you're too used to the smell to notice it. In that case, ask someone who doesn't live with you to take a sniff and give an honest opinion. You should eliminate the smell if there is any. Do not try to cover up an odour or a smell by spraying air freshener around - you never know if a potential buyer is allergic to it. Also, prospective buyers can usually tell the difference between naturally scented air and a home that clearly smells as if it has been doused in air freshener, and some buyers may even become suspicious because of this. If there is an odour, try to locate the source of it. If it is due to leaking pipes or a clogged drain, put it right before hosting any home viewings. You should also take note that the smell of cigarettes may be considered an odour to some people so if you are a smoker, try not to smoke in the house or flat you are selling for that period of time and keep the windows open to air the rooms.</div>

<div>If you are still living in the house or flat you are selling and you happen to have a pet, make sure the pet is out of the house when home viewings are taking place. This is especially so in the case of home sellers who have pet dogs or cats. Some prospective buyers may not be too fond of dogs and cats or may even be afraid of or allergic to them.</div>

<div>Keep the look of the house or flat you are selling as uncluttered as possible. By clearing away the clutter, you can make a small room look larger than it actually is. If you do not have enough space to keep all the clutter, rent a storage unit somewhere for the time being.</div>

<div>Check that lights, air-conditioners, water-heaters, ceiling fans and all power sockets are in good working condition. Replace anything if necessary.</div>

<div>A dimly lit room is hardly appealing to a prospective buyer. Be prepared to invest in additional light fixtures and replace light bulbs if needed. If you are expecting visitors during the day, open the windows or pull back the curtains to let more light through. Sometimes, a new paint job can also enhance the lighting of a room by the way the light reflects off the paint.</div>

<div>Inspect your bathrooms before letting prospective buyers view your home. Dirty bathrooms can be a major turn-off so make sure your bathrooms do not have any dirty towels or mats in sight. Check that the floor tiles and walls of your bathrooms are clean and do not need any replacing or touching up, and that your showers and taps are in good working condition.</div>

<div>If you are still living in the house or flat you are selling, put away as many personal items as possible, especially family photographs. The whole objective of presenting your home for viewing is to sell it and to do that, you need your prospective buyers to be able to imagine themselves living there. Also, if you have any favourite pieces of furniture, make sure you take them out of the house or apartment you are selling. You do not want prospective buyers thinking that it is part of the furniture that comes with the home - and if you tell them that it isn't, it may affect a potential deal.</div>

<div>If you want to freshen up the look of your home, you may want to consider putting flowers in strategic locations around the flat or house. Flowers are generally a pleasant sight to visitors, but if you adopt this tactic, be sure to water the flowers every day and take out any blossoms that start to droop.</div>

<div>It is advisable to remove any wallpaper that you might have put up. Not all prospective home buyers have a liking for wallpaper and in any case, wallpaper often adds a personal touch to the home. Do not paint over any wallpaper you might have put up - remove it and then paint over the wall if necessary.</div>

<div>The exterior of your home matters as much as the inside. If it is a flat you are selling, check that the front door, locks and gate are in good condition. Paint over the door or replace the doorknobs if needed. If the door is clearly not in a good condition, install a new one before anyone comes to view your home. If it is a house you are selling, check that the roof from the outside looks presentable and the house itself looks inviting. Try to be as objective as possible when viewing your house or flat from the outside and remember that you have to make it look alluring enough so that a prospective buyer will walk in. If you are selling a house with a garden, make sure that the lawn has been trimmed and is in a presentable fashion.</div>

<div>Try to be flexible with your home viewings. You may occasionally come across a prospective buyer who will ask to view your flat or house at an odd timing. Be as accommodating as possible. The more home viewings you entertain, the more offers you are likely to receive for the home you are selling.</div>

<div>Home buyers are unlikely to buy a house or flat they cannot inspect. So do not tell your visitors that they cannot inspect a particular room or cabinet during home viewings.</div>

It is not necessary to point out any special features of your home, especially if they are accompanied by a real estate agent. It would be even better if you could leave the house or flat when visitors arrive to view your home. Think of your home as a hotel and you as the concierge, maintenance person and security and you might understand just what being a landlord entails.</span></p>

Equality:</b> In <span style="font-size: small;">Thailand</span>, some landlords tend to adopt a racial stance by insisting that only if the potential tenant is of a specific race, should he then apply. Even if it is an old building, you as the landlord need to ensure that the unit you are renting out is liveable. This means it has to be clean, has proper sanitation, electricity, light, space, free of dust, pests and possibly more. If you cannot see yourself living there, then you should not impose such poor conditions on someone else.</span></p>
<p><span style="font-size: small;"><b>3. Improvements: </b>Just because you're not living in the house does not mean you should not improve it. <p><span style="font-size: small;"><b>4. Expectations:</b> If you expect your tenant to take care of your unit and be of a certain standard, then you will need to set that standard by treating your tenant as a customer and as a fellow human being instead of just a monthly pay check.</span></p>
<p><span style="font-size: small;"><b>5. Listening ear:</b> Check up on your tenant from time to time. Find out if he is comfortable, if everything is working and if he has any problems. If you can assist with things pertaining to the home, do it. The importance of listening to your tenant cannot be adequately explained. Just remember the hotel metaphor and provide your tenant with good customer service. After all, if he is happy, so are you.</span></p>

Deposits:</b> Unless it was explicitly stated in the contract and made known verbally to the tenant at the point of signing that all deposits will be used for any upkeep or maintenance that is directly the fault of the tenant, you must never hold onto the deposits and create new rules to keep it during the tenancy. Give it back when the time is up.</span></p>

<p>While your real estate agent, if you have opted to hire one, will ensure that you are able to find a suitable place to reside in temporarily, it wouldn't hurt to make your own list of things you are looking for in a rental property - and to tick them off as you go.</p>
<ul>
<li>Budget: This is first and foremost the most important thing you will need to consider before anything else. Determining your budget will help you determine the type of rental property that best suits your needs, within your limitations, and should effectively stop you from falling in love with a property that you cannot afford.</li>
</ul>
<p>Having a budget in mind does not only mean taking into account your future expenses for renting a property, but also looking at the price that rental properties typically go for in the location you are considering. This will mean that you have to do some research on the matter, especially if you already have an ideal location in mind.</p>

<p>This is an informative guide regarding the formal procedures for tenants looking to rent residential property in Thailand. It is advisable that you enlist the services of a real estate agent, especially if you are still unsure of the procedures you need to go through. However, this guide should at least be able to give you an idea of what to expect.</p>
<p><b>Renting from a Landlord</b></p>
<p><b>Letter of Intent</b></p>
<p>A Letter of Intent is a formal letter presented by a tenant to a landlord, proposing an offer to rent a residential property. If the landlord signs the letter, it is taken as an official sign of acceptance.</p>
<p>The letter should dictate the tenant's intention to rent the property and his or her conditions. These conditions would most likely have been agreed on between the landlord and the tenant prior to the preparation of the Letter of Intent.</p>
<p>A term of lease, as depicted in a Letter of Intent, can range from 12 months to 24 months, with an option for renewal upon expiration. However, this is subject to any changes made to the rental price by the landlord, based on prevailing market rates, and the tenant may be required to give two to three months' notice in advance to the landlord if he or she wishes to renew it. The standard term of lease in Thailand lasts for 12 months and most landlords will not accept a shorter lease period.</p>
<p>The first deposit made by the tenant, also known as a good faith deposit or a booking deposit, usually amounts to one month's rent. When a landlord accepts the deposit, and has signed a tenant's Letter of Intent, he or she has essentially promised not to offer the property to lease to other prospective tenants until a Tenancy Agreement has been signed. After the Tenancy Agreement has been signed, the deposit can be kept either as payment for the first month's rent or as a security deposit.</p>
<p>A security deposit is a deposit made by a tenant after a Tenancy Agreement has been signed. It is kept by the landlord and is only returned to the tenant when his or her term of lease expires. While in the safekeeping of the landlord, the security deposit is not subject to any interest rate and should be refunded to the tenant interest-free.</p>
<p>However, the landlord reserves the right to deduct any expenses incurred should a tenant breach his or her contract or cause damages to the inventory. For a standard term of lease, the tenant is required to make a security deposit amounting to one month's rent. For a 24-month term of lease, the security deposit is equivalent to two months' rent.</p>
<p>The monthly rental price of the property should also be stated in the Letter of Intent. Other conditions or terms which should be stated explicitly in the letter include the level of furnishing, intention to sublet and occasionally, the ownership of pets, if any. It is important to agree on these details with the landlord beforehand, and obtain his or her written approval of the additional requirements in order to avoid the possibility of a misunderstanding taking place later.</p>
<p>Expatriates should look into including an expatriate clause to protect themselves in the event that they are no longer employed in Thailand or are transferred to another country. This clause should allow an expatriate tenant to terminate the contract after a period of 12 months, as long as two months' notice has been given. This will also restore to them their security deposit. However, expatriate tenants should take note that this clause is only accepted if the term of lease is longer than a year.</p>
<p>A Letter of Intent should also carry a clause specifying an expiration date. If a landlord does not sign the Letter of Intent within a certain period, the letter will expire and the landlord will then be required to return the booking deposit immediately.</p>
<p><b>Tenancy Agreement</b></p>
<p>A Tenancy Agreement is usually prepared by the landlord, or his or her property agent. It dictates the landlord's obligation to lease the property to a tenant, and both the tenant and the landlord are required to sign the agreement. The Tenancy Agreement is, in essence, a far more detailed version of the Letter of Intent. It is advisable to use the standard form of the Tenancy Agreement.</p>
<p>Any legal fees incurred during this process should be the responsibility of the tenant. However, if there are no amendments to be made to the landlord's Tenancy Agreement, there should hardly be any legal fees incurred.</p>
<p>The tenant is also required to provide the landlord with a copy of his or her passport and identification card or employment pass, if he or she is a foreigner. It is necessary for the landlord to verify that the tenant is allowed to stay in Thailand as the landlord will be deemed to have committed an offence if he or she rents out residential property to illegal immigrants.</p>
<p>Upon signing the Tenancy Agreement, the tenant must pay the sum of the first month's rent and the security deposit, less the booking deposit made with the signing of the Letter of Intent.</p>
<p>Some things tenants should look out for in a Tenancy Agreement are:</p>
<p>Tenant's identification details</p>
<p>Landlord's identification details</p>
<p>Terms of payment</p>
<p>This includes details such as the date the rent must be paid by for every month and the mode of payment.</p>
<p>Security deposit</p>
<p>This concerns the amount that is paid for every standard term of lease.</p>
<p>Inventory of contents</p>
<p>This is basically an inventory list, which is a supplement of the Tenancy Agreement. The inventory of contents lists all furniture and fittings in the rental property as they are in their present condition.</p>
